Apple and Google Lose Antitrust Battle in Australian Court

The Federal Court of Australia ruled on Tuesday that Apple and Google engaged in anti-competitive behavior by abusing their market dominance in app distribution, marking a significant victory for Epic Games in its ongoing global legal crusade, ABC News reported.

Court Findings on Market Dominance

Presiding Judge Jonathan Beach determined that both tech giants leveraged their dominant positions to stifle competition within their respective app marketplaces. However, the court notably rejected Epic Games’ allegations that the companies had engaged in “unconscionable conduct,” creating a nuanced legal outcome for both sides.

Epic Games’ Global Strategy

Epic Games has spent years challenging the fee structures and in-app purchase policies enforced by Apple and Google across multiple international jurisdictions. This latest ruling mirrors a major victory Epic secured in the U.S. earlier this year, which successfully facilitated the return of Fortnite to the American App Store after a five-year absence.

Impact on the Australian Market

Following the decision, Epic Games CEO Tim Sweeney confirmed that the Epic Games Store and Fortnite are set to make a comeback in Australia shortly.

The Response from Tech Giants

Google issued a statement expressing partial satisfaction with the ruling while contesting the court’s view on its billing policies. “We welcome the court’s rejection of Epic’s demands that we distribute app stores from within the Google Play store, and Epic’s attacks on other critical security protections that users rely on. However, we disagree with the court’s characterisation of our billing policies and practices, as well as its findings regarding some of our historical partnerships,” a Google spokesperson said.

Apple maintained its stance that its platform remains the most secure environment for users, explicitly stating its disagreement with the court’s findings regarding Epic’s specific claims.
